1. About these terms
These terms apply to Oftaro (the “App”), a habit tracker for Android developed and published by Tendanto Ltd, a private limited company registered in England & Wales (company no. 17481182), 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom (“we”, “us”). By installing or using the App you accept these terms.
Google Play’s own terms also apply to downloading the App and to purchases made through Google Play. How the App handles your data is described in the Oftaro Privacy Policy.
2. Your licence
We give you a personal, non-exclusive, non-transferable licence to use the App on Android devices you own or control, for your own non-commercial use.
You must not copy, modify, resell or redistribute the App, try to extract its source code except where the law allows, remove its notices, or use it in a way that breaks the law or harms others.
3. The free version
The App is free to use. Free users see one small ad for another of our own apps and can keep one “less” habit (a habit you want to do less of) at a time.
4. Oftaro Pro
Oftaro Pro removes the ad and lifts the limit on “less” habits. It is sold through Google Play as a monthly or yearly subscription or as a one-time lifetime purchase. Prices are shown in the App and on Google Play in your local currency, including any taxes Google Play charges.
Subscriptions renew automatically at the end of each period at the then-current price, unless you cancel in Google Play (Play Store › Payments & subscriptions › Subscriptions) before the renewal date. Cancelling stops the next renewal; you keep Pro until the end of the period you paid for.
Free trials and introductory offers. Some plans may come with a free trial or an introductory price, as shown before you buy. Google Play decides who is eligible, usually new subscribers only. When a free trial ends you are charged for the plan, unless you cancel before then. The App reminds you two days before a trial ends.
Lifetime purchase. The one-time purchase unlocks Pro, without renewals, on the Google account you bought it with, for as long as we offer the App on Google Play.
If we change a subscription price, Google Play tells you in advance, and you can cancel before the new price applies.
5. Refunds and your rights
Payments and refunds are handled by Google Play under its refund policy (support.google.com/googleplay). You can request a refund through Google Play; we can also ask Google to refund a purchase where that is fair.
If you are a consumer in the UK or the EU, you have legal rights for digital content that is faulty or not as described, and nothing in these terms affects them. When you buy, you agree that Pro starts straight away; as far as the law allows, this means the 14-day right to cancel ends once it has started.
6. Your data
Your habits are stored on your device, and in your own Google Drive if you turn on backups; we have no copy of them. Keep your own backups, for example with the App’s export or Google Drive backup: if you uninstall the App or lose your device without one, we cannot recover your habits.
7. Not medical advice
Oftaro helps you track habits. Its scores, charts and suggestions are not medical, psychological or professional advice. If a habit relates to your health, such as sleep, diet, alcohol or medication, talk to a qualified professional.
8. Changes to the App and these terms
We may update the App, add or remove features, or stop offering it. If we stop offering Pro features you have paid for, we will tell you in advance where we can, and you can ask for a refund of the unused part of a subscription.
We may update these terms. The date at the top of this page shows when they last changed, and continuing to use the App afterwards means you accept the updated version.
9. Liability
Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, or for fraud.
Otherwise, we are not liable for losses that were not reasonably foreseeable, or for business losses. Our total liability to you in connection with the App is limited to the amount you paid for Oftaro Pro in the 12 months before the claim.
10. Ending
You can stop using the App at any time by uninstalling it and cancelling any subscription in Google Play. We may end your licence if you seriously break these terms.
11. Governing law and contact
These terms are governed by the law of England & Wales, and its courts have jurisdiction. If you live in Scotland, Northern Ireland or the EU, you may also bring proceedings in your local courts, and you keep the protection of the mandatory laws of your country.
